DREAMers – Deferred Action from Removal from the United States

On June 15, 2012, Secretary of Homeland Security Janet Napolitano announced that DHS will, in the exercise of its prosecutorial discretion, consider granting deferred action to individuals who:

  • Came to the United States under the age of 16;
  • Have continuously resided in the U.S. for at least five years preceding January 1, 2010;
  • Are currently in school, have graduated from high school, have obtained a GED, or are an honorably discharged veteran of the Coast Guard or U.S. Armed Forces;
  • Have not been convicted of a felony, a significant misdemeanor, or multiple misdemeanors, or do not otherwise post a threat to national security or public safety; and

On December 16th, President Obama announced a new program to allow parents of US citizens to stay and work in the USA. You must have entered the USA prior to January 1, 2014 and have a U.S. citizen son or daughter.

  • Individuals who have been identified through the ongoing prosecutorial discretion case review process announced on November 17, 2011: ICE is instructed to immediately begin the process of deferring action against individuals who have already been identified as meeting the criteria and who have been offered administrative closure or termination as part of the ongoing prosecutorial discretion case review process, even if they declined the offer.
  • Individuals who are encountered by ICE or CBP: ICE and CBP are instructed to immediately exercise discretion to prevent those who meet the criteria from being placed in removal proceedings or removed from the United States.

El 16 de Diciembre, el Presidente Obama anunció un nuevo programa para permitir a los padres de ciudadanos Estadounidenses a permanecer y trabajar en los Estados Unidos. Usted debe haber entrado en los Estados Unidos antes del 1 de Enero de 2010 y tienen un hijo ciudadano Estadounidense o hija.

Las personas que han sido identificadas a través del proceso de revisión en curso de la fiscalía caso discreción anunció el 17 de Noviembre de 2011: ICE es instruido para comenzar inmediatamente el proceso de diferir la acción contra las personas que ya han sido identificados como el cumplimiento de los criterios y que se han ofrecido cierre administrativo o rescisión como parte del proceso de enjuiciamiento en curso de revisión de casos discreción, aunque declinaron la oferta.

Las personas que se encuentran por el ICE o CBP: ICE y CBP son instruidos para ejercer inmediatamente discreción para evitar que aquellos que cumplen con los criterios de ser puesto en proceso de deportación o retirado de los Estados Unidos.
